These Terms of Service (“Terms”) govern your use of radio streams, articles, playlists, videos, member accounts, community areas, submission channels, forms, and related content and services.
Power1047.com is owned and operated by Hopkins & Ricks Media Group (“Power1047,” “we,” “us,” or “our”).
By accessing Power1047.com, creating an account, listening to our programming, submitting content or information, or otherwise using our services, you agree to these Terms and our Privacy Policy. Do not use the services if you do not agree to these Terms.
1. Eligibility and mature content
Power1047.com is a general-audience music, entertainment, news, and culture platform primarily intended for individuals who are at least 18 years old.
Our programming and editorial content may include explicit lyrics, adult language, mature discussions, uncensored music, or other material that may not be suitable for children. Parents and legal guardians are responsible for supervising minors who access the services.
The services are not directed to children under 13. Individuals under 13 may not create an account, participate in community features, subscribe to communications, submit content, or otherwise provide personal information through Power1047.com.
By creating an account or submitting information, you represent that you are legally permitted to do so and that the information you provide is accurate.
2. Description of the services
Power1047 may provide:

We may add, remove, modify, suspend, or discontinue any program, stream, schedule, playlist, article, account feature, community function, or other service at any time.
We do not guarantee that any particular program, song, article, presenter, feature, stream, or service will always be available, uninterrupted, secure, or error-free.
3. Member accounts
Certain services may require you to create an account.
When creating or using an account, you agree to:

Provide accurate, complete, and current information.

Maintain the confidentiality of your password and login credentials.

Accept responsibility for activity conducted through your account.

Notify us promptly if you suspect unauthorized access.

Avoid impersonating another person or organization.

Avoid creating an account using false or misleading information.

Use the account only for lawful purposes.
You may not sell, transfer, rent, or share your account with an unauthorized person.
We may reject a registration, require a username or profile change, limit account features, suspend an account, or terminate an account when reasonably necessary to protect Power1047, our users, our services, or third parties.
4. Community standards
Power1047 community areas are intended to support respectful discussions about music, entertainment, culture, artists, programming, and related subjects.
You may not post, upload, publish, transmit, or otherwise make available content that:

Is unlawful, fraudulent, threatening, abusive, harassing, defamatory, or deliberately misleading.

Contains unlawful hate speech or unlawful discriminatory content.

Sexually exploits or endangers minors.

Violates another person’s copyright, trademark, privacy, publicity, contractual, or other rights.

Reveals another person’s confidential or private information without authorization.

Contains malware, viruses, destructive code, phishing attempts, or harmful software.
-
Promotes scams, identity theft, fraudulent opportunities, or unauthorized payment requests.
-
Includes spam, repetitive promotions, or unauthorized commercial solicitation.
-
Impersonates Power1047, its owners, staff, presenters, artists, advertisers, or another user.
-
Manipulates engagement, reactions, views, account activity, or website traffic.
-
Interferes with the operation or security of the services.
-
Encourages illegal conduct.
-
Is otherwise inconsistent with the safety or intended purpose of the community.
We may moderate, edit, restrict, reject, move, or remove content at our discretion. We may also suspend or terminate users who violate these standards.
We are not obligated to monitor every submission and do not endorse opinions, claims, recommendations, or other statements posted by users.
5. User Content
“User Content” means comments, community posts, profile information, photographs, videos, audio recordings, links, messages, reviews, and other material submitted through public or interactive portions of the services.
You retain ownership of your original User Content.
By posting or submitting User Content, you grant Hopkins & Ricks Media Group a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to:

Host and store the User Content.

Reproduce and display it through Power1047 services.
-
Distribute it in connection with operating or promoting the services.
-
Reformat, resize, crop, or technically adapt it.
-
Display it through Power1047-controlled websites, newsletters, broadcasts, and social media accounts.

Use excerpts for reasonable promotional or editorial purposes.
This license allows us to operate community features and promote public participation. It does not transfer ownership of your original work to us.
You represent that:

You own the User Content or have permission to submit it.

The User Content does not violate another person’s rights.
-
Our permitted use of the User Content will not violate any agreement or law.
-
The information you submit is not knowingly false or deceptive.
-
You are responsible for any royalties, fees, permissions, or clearances associated with the User Content.
Deleting User Content may not immediately remove copies contained in system backups, previous publications, search engine caches, screenshots, lawful business records, or content shared by other users.
6. Music and artist submissions
Music, electronic press kits, recordings, photographs, artwork, biographies, videos, metadata, and related promotional material may be submitted for possible editorial, programming, playlist, interview, or broadcast consideration.
By submitting music or promotional materials, you represent that:

You are the owner or an authorized representative of the submitted materials.

You have the authority to make the submission.
-
You have obtained all necessary permissions for recordings, compositions, beats, samples, features, artwork, photographs, names, and likenesses.

The submission does not infringe another person’s intellectual property, privacy, publicity, contractual, or other rights.

The information, credits, and metadata provided are accurate.

The submission does not contain malware or harmful files.
You grant Hopkins & Ricks Media Group a nonexclusive, worldwide, royalty-free license to receive, store, reproduce, organize, and internally review submitted materials.
If a submission is selected for coverage, airplay, a playlist, an interview, or promotion, you also authorize Power1047 to make reasonable use of the artist’s name, approved biography, artwork, photographs, song information, excerpts, and promotional materials to identify, discuss, announce, or promote the selection.
Submitting material:

Does not guarantee review.

Does not guarantee airplay, playlist placement, an interview, an article, feedback, or promotion.
-
Does not require Power1047 to respond.
-
Does not create an employment, agency, partnership, fiduciary, or confidential relationship.
-
Does not obligate Power1047 to pay compensation unless a separate written agreement expressly provides otherwise.
-
Does not transfer ownership of the submitted recording or composition.
-
Does not prevent us from receiving or developing similar content independently.
We may decline, delete, or stop reviewing a submission at any time.
Submitters remain responsible for copyright registrations, performance rights registrations, publishing obligations, licenses, sample clearances, union requirements, and contractual obligations affecting their work.
Power1047 does not authorize representatives, presenters, social media accounts, or other persons to guarantee airplay or coverage in exchange for unauthorized payments. Suspected impersonation or payment scams should be reported to info@power1047.com.
7. Editorial and informational content
Articles, interviews, playlists, broadcasts, commentary, reviews, recommendations, and other editorial material are provided for general information and entertainment.
Although we aim to publish reliable and current information, we do not guarantee that every item will always be complete, accurate, current, or free from error.
Release dates, event schedules, streaming availability, prices, credits, appearances, programming schedules, and other information may change after publication.
Editorial content does not constitute legal, medical, financial, investment, tax, or other professional advice.
Opinions expressed by artists, guests, presenters, users, contributors, interview subjects, or advertisers belong to those individuals and do not necessarily represent Hopkins & Ricks Media Group or Power1047.
We may correct, update, clarify, remove, or archive content without notice.
8. Power1047 intellectual property
Except for User Content and third-party material, Power1047.com and its original content are owned by or licensed to
Hopkins & Ricks Media Group.
Protected material may include:

Power1047 names, logos, slogans, and branding.

PowerPage branding and editorial presentation.

Website design and page layouts.
-
Articles, graphics, photographs, and videos.
-
Station imaging and original audio productions.
-
Program names and promotional campaigns.
-
Databases, collections, compilations, and playlists.

Written, visual, and audio content created for Power1047.
You may access the services for personal, noncommercial use.
Unless we provide prior written permission, you may not:

Reproduce or republish substantial portions of the website.

Record, rebroadcast, retransmit, or commercially redistribute a Power1047 stream.

Sell, license, or commercially exploit our original content.

Remove copyright, trademark, attribution, or rights management notices.

Use our names, logos, or branding to imply sponsorship, authorization, or endorsement.

Mirror, frame, scrape, harvest, or systematically extract website content.

Use automated systems to create an unauthorized archive or database.
-
Modify or create derivative commercial works from our content.
-
Use our content or branding in connection with fraud, impersonation, or misleading promotions.
Limited quotations from editorial content may be used when legally permitted and accompanied by clear attribution to Power1047.com.
9. Copyright complaints
Hopkins & Ricks Media Group respects intellectual property rights.
A copyright owner or authorized representative who believes material appearing on Power1047.com infringes a copyright may send a written notice to:

10. Third-party services and content
Power1047.com may contain links, music players, embedded videos, advertisements, social media features, radio directories, ticket links, product links, or other integrations operated by third parties.
Third-party services may include music streaming platforms, video providers, social networks, advertisers, event organizers, artists, labels, and other websites or applications.
These third parties have their own terms, privacy policies, security practices, and content standards.
Hopkins & Ricks Media Group does not control and is not responsible for:

Products or services offered by third parties.

Statements, representations, or promises made by third parties.

Transactions between users and third parties.

Content hosted outside Power1047.com.

Losses caused by a third-party website or platform.
A link, embed, mention, article, interview, playlist placement, or social media reference does not necessarily constitute an endorsement.
Your interactions with third parties are between you and the applicable third party.
11. Advertising and sponsored content
Power1047 may provide advertising, sponsorship, promotional, contest, giveaway, and branded content opportunities.
Separate agreements or rules may apply to advertisers, sponsors, campaign participants, and promotional activities. When separate written terms conflict with these Terms, the separate terms control the applicable transaction or promotion.
Advertisers and sponsors are responsible for ensuring that their:

Creative materials do not infringe third-party rights.

Promotions, contests, and offers include legally required terms.

Landing pages and linked services are accurate and secure.
Unless expressly stated in a signed written agreement, Power1047 does not guarantee:

A particular number of listeners, impressions, views, or clicks.

Leads, purchases, subscriptions, or conversions.
-
Specific audience demographics.

Editorial coverage.
-
Continued placement after a campaign ends.

Particular commercial results.
Sponsored or promotional content may be identified through labels or disclosures when appropriate.
12. Contests and promotions
Contests, giveaways, sweepstakes, and similar promotions may be governed by separate official rules.
Those rules may address eligibility, entry periods, prize details, winner selection, publicity permissions, taxes, and other conditions.
If promotion-specific rules conflict with these Terms, the promotion-specific rules govern that promotion.
13. Prohibited technical conduct
You may not:

Circumvent security controls, access restrictions, or technical limitations.

Attempt to access another person’s account.

Probe, scan, or test the vulnerability of the services without written authorization.

Introduce malware, viruses, destructive code, or automated attacks.

14. Suspension and termination
We may suspend, restrict, or terminate access when we reasonably believe:

We may retain information when reasonably necessary to satisfy legal obligations, resolve disputes, enforce agreements, prevent fraud, or maintain lawful business records.
Provisions that should logically survive termination will remain effective, including intellectual property protections, disclaimers, liability limitations, indemnification, and dispute provisions.
15. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
HOPKINS & RICKS MEDIA GROUP DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT:

THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

EVERY PROGRAM, STREAM, ARTICLE, OR FEATURE WILL REMAIN AVAILABLE.

THE SERVICES WILL BE FREE FROM HARMFUL COMPONENTS.

INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT.

THE SERVICES WILL BE COMPATIBLE WITH EVERY DEVICE, BROWSER, NETWORK, OR THIRD-PARTY PLATFORM.

USER CONTENT OR THIRD-PARTY CONTENT WILL BE ACCURATE OR RELIABLE.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the maximum extent legally permitted.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPKINS & RICKS MEDIA GROUP AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, PRESENTERS, AND LICENSORS WILL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

LOST PROFITS, REVENUE, DATA, BUSINESS, OR OPPORTUNITIES.

BUSINESS INTERRUPTION.

REPUTATIONAL HARM.

UNAUTHORIZED ACCOUNT ACCESS.

USER CONTENT OR THIRD-PARTY CONTENT.

THIRD-PARTY SERVICES OR TRANSACTIONS.

LOSS ARISING FROM RELIANCE ON EDITORIAL OR ENTERTAINMENT CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID DIRECTLY TO HOPKINS & RICKS MEDIA GROUP FOR THE RELEVANT SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM; OR
-
ONE HUNDRED U.S. DOLLARS.
These limitations do not apply to liability that cannot legally be excluded or limited.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hopkins & Ricks Media Group and its owners, affiliates, officers, employees, contractors, contributors, presenters, and licensors from claims, damages, liabilities, losses, judgments, and reasonable expenses arising from:

Your violation of these Terms.

Your User Content.

Your music or artist submission.
-
Your infringement of another person’s rights.
-
Your unlawful or unauthorized use of the services.
-
Your fraud, misconduct, or misrepresentations.
We may assume control of the defense of a covered claim. You agree to provide reasonable cooperation.
18. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.
Before filing a formal legal claim, you agree to send a written description of the dispute to:

The notice should describe the relevant facts, the relief requested, and your contact information.
The parties will have at least 30 days to attempt an informal resolution unless immediate action is legally necessary.
A dispute that is not resolved informally may be brought in a state or federal court having lawful jurisdiction in Maryland, except where applicable consumer law requires or permits otherwise.
Nothing in these Terms prevents either party from seeking appropriate relief in small claims court or requesting urgent injunctive relief to protect intellectual property, confidential information, personal safety, or system security.
19. Changes to these Terms
We may update these Terms to reflect changes in our services, technology, business practices, or legal obligations.
The revised Terms will be posted with a new effective date. Material changes may also be communicated through the website, an account notice, or email when appropriate. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
